The House of Lords has put consideration of an appeal over grazing rightson common land
adjoining farm land in Cornwall on hold. Lords Hope, Clydeand Hobhouse have set a 23
July deadline for objections to be lodged to thepetition for leave to appeal. The case
centres on Sina Farm in Cornwall. The owners of part of the land seek a declaration that
the grazing rightsover Tawna Down are annexed to, and could only run with, their land
at SinaFarm. They claim that a purported conveyance by the previous owner wasineffective
and that as a matter of law, grazing rights historically linkedan area of land belonging
to a farmer exercising those rights. They say therights cannot be separated from that
land in the way it is claimed hashappened here.
