Both the UK and Europe have prioritised updating intellectual property rules to keep pace with technological developments and to enable greater co-operation and harmonisation between member states.

The UK has announced an Intellectual Property Bill that will reform the UK design right regime and enable the UK to implement the Unitary Patent Court agreement. In addition, the Enterprise and Regulatory Reform Act 2013 (ERRA), which enacts a number of copyright law reforms, has achieved Royal Assent.

Assuming it is passed as drafted, the Intellectual Property Bill will considerably strengthen the UK’s protection for registered designs. The ERRA makes provision for the licensing of orphan works and for extended collective licensing…
