CC wins Court of Appeal fight with Fulham FC

Clifford Chance has won a Court of Appeal ruling on behalf of client Jean Tigana, the former manager of Fulham Football Club, in his dispute with the club.

The Court of Appeal this morning (Tuesday 19 July) handed down a unanimous decision dismissing Fulham’s appeal against a November 2004 High Court judgment finding that Tigana was not in breach of his contract or his duties.

Today’s decision upholds that judgment and the damages of more than £2m which Mr Justice Elias awarded.

Fulham, represented by Kendall Freeman’s managing partner Laurence Harris, claimed that it suffered losses as a result of Tigana’s actions. The club dismissed Tigana in June 2003 for gross misconduct; Tigana later won £445,000 in an employment tribunal case.

Clifford Chance assistants Nick Tsatsas and Kiersten Lucas represented Tigana, instructing Paul Goulding QC of Blackstone Chambers. Harris instructed Wilberforce Chambers’ Ian Croxford QC.
