The Unified Patent Court agreement is signed — what does it mean for you?
This briefing looks at the signing of the Unified Patent Court (UPC) agreement. After 40 years of attempts to bring a single patent system to Europe, this promises the ability to obtain pan-European enforcement of patent rights in a single set of proceedings for the first time.
The UPC will enter into force on the later of 1 January 2014 or four months after its thirteenth ratification. Of the thirteen ratifications that are needed to bring the UPC into force, those of the UK, France and Germany are essential.
The Unitary Patent is theoretically available from 1 January 2014, but this too is subject to the UPC coming into force…
