Shutting down rogue websites: international and domestic solutions — the UK perspective
The views expressed in this paper are given from the perspective of the solutions and strategies available to shut down rogue sites in the UK. As the topic relates specifically to ‘rogue’ websites, it is important to understand what is meant by a rogue website and to distinguish a rogue site from a legitimate site. There is no legal definition of ‘rogue website’, but the writer offers his own definition in the next paragraph of this paper, headed ‘Definitions’.
The reason for making a distinction between a rogue site and a legitimate site is that, in the case of the former, it may be possible (but not easy) to shut down the site entirely, whereas in the latter it is not possible to shut down the site entirely, but other remedies are available.
This paper will concentrate on the legal action that can be taken in the UK against rogue sites, because the subject of this session is rogue sites. The writer will, nevertheless, towards the end of this paper, refer to strategies available against legitimate sites, in order to illustrate the different approaches to the remedies available in such cases…
