Maritime transport antitrust guidelines will not be renewed

On 19 February 2013, the European Commission decided to allow the guidelines on the application of the Commission’s treaty to maritime transport services (2008/C 245/02) to lapse rather than prolong or overhaul them. The current guidelines will therefore expire on 26 September 2013.

The recent decision of the Commission to let the Maritime Transport Guidelines expire constitutes another significant step in the direction of subjecting maritime transport to the established and generally applicable body of EU competition law.

The first significant step in this direction was the abolition in 2003 of the applications and notifications system set out in Regulation (ECC) No 4056/86 which allowed the line shipping companies to obtain individual exemptions for certain types of agreements which restricted competition…
