Class Actions in Australia — The Year in Review 2012
Coinciding with the 20th anniversary of the class actions regime in Australia, King & Wood Mallesons has launched a report entitled Class Actions in Australia — The Year in Review 2012. The report examines key class action decisions over the past 12 months and considers the impacts of key decisions in class action proceedings on plaintiffs and defendants.
We examine the size of recent settlements and the role respondents play in the process, the rise of institutional investors and litigation funders and the evolving ways in which class action procedure is applied. We also consider the targets of class actions, including company directors, officers and advisors, and the level of awareness companies have about the risks arising from this type of litigation.
With some of the largest yet natural disaster and public liability class actions due for trial in 2013, as well as rulings on the ability of companies and directors to have recourse to directors’ and officers’ (D&O) insurance proceeds ahead of class action claimants, it appears that we will continue to live in interesting times during the year ahead.
