Brands Update: marked end of a registration watchdog — descriptiveness in Austria

During its short-lived function as the last resort for trademark applicants whose applications had been refused at the Austrian Patent Office (PTO), the Supreme Trademarks and Patents Senate (OPM) overruled the PTO in about three quarters of the cases brought before it.

Among others, it allowed the registration of Wonderful Tonight for soaps, technology.at for business administration and consultancy, lounge.at for entertainment, Die grüne Linie (trans: ‘the green line’) for cosmetics and industrial oils, Malzmeister (trans: ‘malt master’) for bread and pastry, Gute Laune (trans: ‘good mood’) for tea and Primera for automobiles…
