  • The challenge of enforcement

    There are some at the bar for whom the cab rank principle is merely a convenient convention to be applied only when in a barrister's self interest. Whatever the results of the consultation paper (probably just another consultation to consider the findings of the first consultation) the BSB must tackle the key issue of enforcement. I don't know what the answer is but the cab rank rule is one of many that is very hard to police and in this day and age it seems unlikely that the profession could or should be satisfied with some form of self-regulation.
