Last year Robert Kearns, senior partner of Swansea-based Kearns & Co, sued the Bar Council for writing to barristers advising them not to work with him because he was not a solicitor.In July the High Court found that the Bar Council was not liable for damages, as communications between it and its members should be protected by qualified privilege.Kearns, represented by libel specialists Peter Carter Ruck and Partners and Richard Rampton QC, then took the case to the Court of Appeal.Neither Kearns, his lawyers nor the Bar Council could comment on the pending judgment, because although it was embargoed for public consumption until today (17 March), they already know the result.Berrymans Lace Mawer and Andrew Caldecott QC acted for the Bar Council.Go to www.thelawyer.com/ lawyernews today to see the result.
