  • As a Director of ALF I think we can say we did all we could, working with counsel to bring this matter to a speedy conclusion. The point around transparency though, remains somewhat overstated. We at Harbour are surprised how rarely we are asked by those advising claimants or the claimants themselves, to verify that we have sufficient capital to fund all of our liabilities. We would expect advisors to do that in any commercial transaction (as we do when we contract with any counter party) so why is litigation funding any different?
    The policing cannot be completely outsourced to the Association of Litigation Funders - claimants and their advisors remain primarily responsible for taking common sense actions to satisfy themselves who their counterparty is.

  • Susan's point is well made and previously noted by Lord Justice Jackson in his Costs Review - before his recommendation of a voluntary code of conduct administered by ALF. In short, he couldn't identify claimants who were not commercial entities and not represented. ALF is doing what it was created to do and more. It will continue to evolve, but can't be the panacea some journalists appear to crave.
