Almost 90 per cent of large US companies have used mediation to settle disputes in the past three years, according to a recent survey of more than half of America's largest companies. The report also revealed that 79 per cent of companies used arbitration. However, while Alternative Dispute Resolution (ADR) is on the increase, 50 per cent of the in-house counsel questioned said they lacked confidence in the qualifications of arbitrators who hear cases, and 30 per cent displayed a lack of confidence in mediators. The survey into ADR was conducted by Cornell University, the Foundation for the Prevention and Early Resolution of Conflict and the consulting unit of Price Waterhouse. The study results were based on responses from 530 of the US's leading 1,000 companies.
